Special AFLA event on new guidance in family actions

Family law practitioners heard expert analysis of an innovation in Court of Session litigation at a special Faculty of Advocates event.

The Advocates’ Family Law Association (AFLA) hosted the launch of a new Practice Note on affidavits in family actions, which comes into effect next week (24 September). It is designed to provide updated guidance, in light of the increased use of affidavits as evidence-in-chief in defended cases.

Lord Brailsford introduced the note, while Lynda Brabender QC and Ruth Innes QC, offered advice on preparing for and running a case involving affidavits. Lady Wise joined the others in a panel discussion.

Mrs Innes, AFLA vice-chair, said: “Affidavits have now been used for some time in defended family actions in the Court of Session. The formulation of the new Practice Note was informed by that practical experience.

“The seminar provided a valuable opportunity to raise awareness, hear views from the Bench and discuss the development of practice in light of the Note.”
