A motorist who chugged an entire bottle of liquor shortly after being pulled over has been acquitted of drink driving after a court concluded it was impossible to tell if he was already drunk.
The court in Daegu, South Korea, heard that the suspect drank an entire bottle of soju – which typically has an ABV of around 20 per cent – in the 39 seconds between pulling over and exiting his car.
A breath test was not conducted until 40 minutes later, though police tried to use the ‘Widmark formula’ to calculate his blood alcohol content prior to the consumption of the soju, The Korea Herald reports.
The court said: “Even if the defendant did drink the entire bottle of soju as he claimed, it is unclear why he would appear intoxicated immediately afterward.
“But we cannot definitively confirm that he was drunk while driving based on such circumstantial evidence or speculation.”
