A man suing Disney for the alleged wrongful death of his fiancée has been told suing breaches the terms of his Disney+ subscription.
Disney’s lawyers raised eyebrows internationally by telling a New York court that Jeffrey Piccolo had agreed to handle all disputes with the company through arbitration when he signed up for a one-month trial of the Disney+ streaming service in 2019.
Piccolo is suing the company over the death of his fiancée Kanokporn Tangsuan, who died of a fatal allergic reaction after eating at a restaurant in Disney Springs in October 2023.
Lawyers for Piccolo have told the court that Disney’s argument is “fatally flawed”, The New York Post reports.
“The notion that terms agreed to by a consumer when creating a Disney+ free trial account would forever bar that consumer’s right to a jury trial in any dispute with any Disney affiliate or subsidiary, is so outrageously unreasonable and unfair as to shock the judicial conscience, and this court should not enforce such an agreement,” they said.
