Sultan Monsour, 45, was arrested in London and charged with being “outside of the place where you were living, namely no fixed address”, The Guardian reports.

He was brought before Judge Alexander Jacobs at Westminster Magistrates’ Court, who questioned the Crown Prosecution Service’s decisions.

Judge Jacobs said: “Is it not a defence that the regulation doesn’t apply to a person who is homeless? If he is homeless then the charge ‘that he left the place he was living, namely no fixed address’ doesn’t make sense to me.”

However, prosecutors insisted that the trial go ahead because he was travelling unnecessarily and had initially told officers he had an address.
