Donald Franz of Donald Franz Law Offices derided his own client as “some kind of small penis asshole”, according to a filing by the Illinois Attorney Registration & Disciplinary Commission, and challenged him to a Wild West confrontation… in small claims court.

His bizarre email attack on client Mike Rutkowski was sparked by an outstanding fee of just $400 USD (around £255).

Mr Franz wrote: “Can you please tell me where you would like to be served? Fee agreements are not required in these matters and not between men. My mistake, there is only one man involved between us.

“I challenge you to a duel, you pick the time, place and manner. I choose small claims court. See you very soon. Don.”

Defending his strongly-worded email, Mr Franz said: “In its totality, the email is not a threat of violence or challenge to a duel, it is a threat to sue in small claims court.”

The filing notes: “All funds paid by Rutkowski have been refunded to him.”
