British Airways and UK government sued over 1990 Kuwait flight hostage-taking

British Airways and the UK government are being sued by nearly 100 people who were taken hostage in 1990 after their plane landed in Kuwait shortly after the beginning of the Iraqi invasion.

McCue Jury & Partners LLP is representing 95 claimants who were passengers or crew members aboard British Airways Flight 149 and subsequently subjected to torture, rape and other abuse by Iraqi troops, The Guardian reports.

The lawsuit against the Foreign, Commonwealth and Development Office (FCDO), the Cabinet Office, the Ministry of Defence and BA alleges that all were aware that the Iraqi invasion was under way before the plane landed at Kuwait International Airport.

The UK government admitted in 2021 that it was aware of the beginning of the invasion, but denied having told BA.

However, the lawsuit alleges that BA knew of the invasion and that British military forces were covertly on board, which the UK government continues to deny.

Matthew Jury, managing partner of McCue Jury & Partners LLP, said: “The victims and survivors of flight BA149 deserve justice for being treated as disposable collateral.”
