Committee calls for views on Bankruptcy (Scotland) Bill

A new bill has been introduced to the Scottish Parliament which proposes consolidating the law on bankruptcy and the Delegated Powers and Law Reform Committee has issued a call for views on the proposals.
The purpose of the Bankruptcy (Scotland) Bill is to bring together existing legislation to create one accessible piece of law.
Convener of the committee, Nigel Don MSP said: “The purpose of consolidation is to make the law easier to understand as it brings together legislation from a variety of different acts that are often years apart.
“Whilst in looking at consolidation bills the committee doesn’t consider the policy behind the proposals, it’s important that as a committee we understand if this bill is necessary and if it consolidates the law clearly, coherently and consistently.
“The committee’s role is to consider whether the bill should proceed as a consolidation bill. To answer that question, we are looking for views as to whether bankruptcy law should be consolidated and if so whether the approach taken here effectively achieves that.”
