Court of Session: Dave King can head Rangers
South Africa-based businessman Dave King can become a director of Rangers International Football Club PLC, following a decision by the Court of Session.
King was forced to apply for approval under a section of the Insolvency Act last month because of his involvement in the Rangers oldco which went into administration and then liquidation in 2012.
Directors of insolvent companies are usually barred from taking up a post within a ‘phoenix company’ that uses the same or a similar name.
Following the court decision, King said: “I am delighted that at a Court of Session hearing this morning before Lord Woolman my application to become a director of Rangers International Football Club PLC was granted.
“Today’s decision has removed the final legal hurdle for me to take up my role on the Board following the overwhelming mandate at the General Meeting.
“The previous board had raised a little known legal provision stating that because I was a director of Rangers oldco within 12 months of its liquidation that I must obtain court sanction before becoming a director of RIFC because the word ‘Rangers’ is in both company names.”
The 59-year old will now be able to accept his board appointment.
