Donoghue v Stevenson named greatest Session Case
Donoghue v Stevenson has been voted the top Session Case in a poll by the Scottish Council of Law Reporting to mark the bicentenary of the UK’s oldest law reports.
It was all but a certainty that the case of the snail in the ginger beer whose doctrines have spread across the world would triumph. Lord Ericht has more to say below.
The top 10 is as follows:
- Donoghue v Stevenson 1932 SC (HL) 31
- Moorov v HM Advocate 1930 JC 68
- MacCormick v Lord Advocate 1953 SC 396
- Cherry v Advocate General 2020 SC (UKSC) 1 and 2020 SC 37
- Wills’ Trs v Cairngorm Canoeing and Sailing School Ltd 1976 SC (HL) 30
- Steuart v Robertson (1875) 2R (HL) 80
- Duke of Argyll v Duchess of Argyll 1962 SC (HL) 88
- Moncrieff v Jamieson 2008 S.C. (H.L.) 1
- Scott & Sons v Del Sel 1922 S.C. 592
- AXA General Insurance Co Ltd v Lord Advocate 2012 SC (UKSC.) 122
Secretary of the Scottish Council of Law Reporting, Anthony Kinahan, told SLN: “It was gratifying to receive more than 300 votes in the Top Ten Session Cases poll, some from as far afield as Australia, Canada, India and the USA.
“Donoghue v Stevenson was the clear winner, as might have been forecast but Moorov was not too far behind it in the voting. The other case voted for may well have been influenced by the series of pieces published in SLN over the past month but two of the ‘top ten’ (MacCormick v Lord Advocate and Moncrieff v Jamieson did not figure in that series.”
All of the pieces may be found on the SCLR website.
