Equality Act and disability discrimination appeals allowed
The Sheriff Appeal Court has allowed appeals in two related cases and remitted them for proof.
The pursuer claimed that Glasgow City Council and Glasgow Housing Association discriminated against her as a homeless person, on grounds of her disability. Both cases had been dismissed by the sheriff at debate as irrelevant.
The judgments set out the law on claims under various provisions of the Equality Act 2010, and how they interact with duties under the Housing Act.
Kay Springham KC, of Compass Chambers represented the appellant, along with Robert Sutherland of Terra Firma.
