Most appropriate case weighting systems considered in new report

The appropriate ‘case weighting system’ for particular judicial systems is the subject of a new report from the Council of Europe.
The working group on judicial time management of the European Commission for the Efficiency of Justice (CEPEJ) takes stock of the internal management system aimed at assessing the weight of a judicial case, by detailing the judicial time needed for its processing.
Case-weights assess the complexity of different case-types, based on the understanding that one case type differs from the other in the amount of judicial time and effort required to be processed.
Based on a review of the existing bibliography on the subject as well as the methodology used in six European countries, the study makes 12 recommendations for the implementation of a case-weighting system. Among the main conclusions is the need for an active involvement of judges in the process.
The information resulting from the weighting of cases can be used to optimise the allocation of human and budgetary resources within the courts, of judicial cases between judges or to support a broader service management programme.
