Naw it Disney: Judge rejects lawsuit over Toy Story character

A judge has brought to a halt a lawsuit filed by Evel Knievel’s son that accused Disney of profiting from the daredevil’s image through Toy Story 4 character Duke Caboom.

Kelly Knievel had claimed the character was based on his father without permission and amounted to unjust enrichment and an infringement of IP rights.

“Evel Knievel did not thrill millions, break his bones and spill blood just so Disney could make a bunch of money,” Mr Knievel said. 

But Judge James C Mahan in Nevada rejected the argument that Disney had misled customers into believing that Knievel’s estate had endorsed the film and said that while Caboom was “reminiscent” of Knievel, he was “not a literal depiction” of him.
