Report finds Police Scotland justified in use of PAVA spray on man

A report has found that Police Scotland was justified in using PAVA irritant spray to subdue a man whom officers were trying to detain during a drugs search and to prevent him from escaping.
The 32-year-old man had struggled violently with officers trying to detain him prior to the spray being used during the incident in a car park in Dundee on the evening of 8 February 2018.
Police Scotland referred the incident to the PIRC on 16 February 2018, as is standard procedure under the Police, Public Order and Criminal Justice (Scotland) Act 2006 as amended, and the Police Investigations and Review Commissioner (Investigations, Serious Incidents and Specified Weapons) Regulations 2013.
The PIRC report found that the man’s actions posed a danger to the officers trying to detain him and that in the circumstances, the use of the PAVA spray was proportionate and justified.
