SCCRC refers attempted murder conviction to High Court
The Scottish Criminal Cases Review Commission has referred the case of Darren Hughes to the High Court of Justiciary for determination.
On 3 February 2022, in the High Court at Glasgow, the applicant was convicted of assault and attempted murder.
The applicant’s conviction has been referred because the commission concluded that there is fresh evidence in his case. It considers that this fresh evidence is admissible, there is a reasonable explanation for the failure to lead it at the applicant’s trial, that it is capable of being regarded as credible and reliable by a reasonable jury, that it is likely to have had a material bearing on, or a material part to play in, the determination by such a jury of a critical issue at the trial and that as a result a miscarriage of justice may have occurred in respect of the applicant’s conviction for attempted murder.
A statement of reasons for its decision has been sent to the applicant, the High Court, the lord advocate and Crown Office.
