Scottish government issues consultation on raising court fees
The Scottish government has issued a consultation on raising fees in the Court of Session, the High Court of Justiciary, the Sheriff Appeal Court, the Sheriff Court, the Sheriff Personal Injury Court, and the Justice of the Peace Court.
Court fees are a major source of income for the Scottish Courts and Tribunals Service (SCTS) and it has become necessary to increase fees in order to achieve full cost recovery, the government has said. It seeks views on two options each of which is aimed at providing full cost recovery.
In addition, a new simple procedure is to replace summary cause and small claims procedures and the consultation sets out the proposed fees for this new procedure.
The Scottish government is consulting on two options seeking the views of stakeholders on the best way to achieve this. Stakeholders will be able to provide their opinions on which option is better from the point of view of their own court actions and, if they are an organisation, of their clients.
This will help the Scottish government’s decision on which option should be incorporated into the necessary Scottish Statutory Instruments.
The consultation will run until 12 October, 2016.
