Scottish government launches consultation on property factors’ code
The Scottish government has launched a consultation on revisions to the code of conduct for property factors.
The code was brought in under the Property Factors (Scotland) Act 2011, which established a statutory regime for protecting homeowners who use factors. It provides minimum standards for registered factors to abide by.
The act requires that Scottish ministers must from ‘time to time’ prepare a draft code which should be published and then consulted upon with such bodies (as considered appropriate) and with the general public.
This consultation seeks respondents’ views on a revised code of conduct for property factors as ministers believe some requirements could be bolstered and made clearer.
Following consultation, Scottish ministers may amend the revised code and then lay a copy of the code before the Scottish Parliament for its consideration.
