Scottish Law Commission annual report details family reforms

The Scottish Law Commission’s annual report has been published.

The 2024 report outlines progress on the commission’s law reform work during 2024. The commission is currently part way through its eleventh programme of law reform which covers the period from 2023 to 2027.

The report discusses work on a number of projects including: aspects of family law; homicide; securities over land; compulsory owners’ associations in tenements; damages for personal injury; the Tenancy of Shops (Scotland) Act 1949; and execution of documents.

The chair of the commission, Lady Paton said: “2024 has been a productive year for the commission including publications on several topics. 

“A report and draft Bill on Damages for Personal Injury was published. Three discussion papers were published on Tenement Law: Compulsory Owners’ Associations, Aspects of Leases: Tenancy of Shops (Scotland) Act 1949 and Civil Remedies for Domestic Abuse. We welcomed a new commissioner, Ann Stewart, and we are delighted that she has commenced work on the project relating to execution of documents. 

“We are pleased that continued progress is being made on the implementation of commission reports with Royal Assent being granted to the Trusts and Succession (Scotland) Act 2024; the Scottish Parliament passing the Judicial Factors (Scotland) Bill and the introduction of the Leases (Automatic Continuation etc) (Scotland) Bill into the Scottish Parliament.”
