Scottish Legal Views: Usman Tariq talks intellectual property
Two lawyers are hoping to make Scotland a more competitive forum for intellectual property litigation.
Ampersand Advocates‘ Usman Tariq and Burness Paull partner Colin Hulme are devising reforms that would allow the Court of Session to compete with England and Wales’ Intellectual Property Enterprise Court (IPEC).
In the latest video in our Scottish Legal Views series, Mr Tariq discusses the importance of intellectual property – “the most valuable asset in the world”.
As he notes, Airbnb owns no properties and Uber no taxis.
He talks about the increasing volume of contentious IP business in the Court of Session and its advantages over the courts of England and Wales but also the challenges posed by the IPEC and the potential ‘IPEC-like’ reforms he and Mr Hulme are preparing.
These would increase Scotland’s competitiveness and see the introduction of a cost cap and a simplified procedure for lower value and less complex IP disputes – opening up this jurisdiction to SMEs and businesses that would otherwise not litigate in Scotland because of the cost.
