Tackling complex birth damages claims
Birth damage claims are generally considered to be the most complex type of medical negligence cases.
The alleged negligence usually relates to failures on the part of obstetric and/or midwifery staff shortly prior to delivery (with the pursuer arguing that earlier delivery is likely to have avoided the damage).
A multidisciplinary approach is required which involves instructing a number of different medical experts such as obstetricians / neonatalologists / neurologists and neuro-radiologists.
Darren Deery, solicitor at Drummond Miller LLP (pictured), has a particular interest in pursuing cases of this nature and his firm has been involved in many of the high value cerebral palsy/birth damage claims going through theCourt of Session in recent years.
