Workers who allegedly assaulted inmate dismissed

Four employees of a prison escort firm were sacked after they allegedly assaulted a prisoner in a court’s cells.

The Geoamey workers were accused of attacking the inmate at Hamilton Sheriff Court last March.

The company confirmed they had been fired following the incident but no criminal charges have been brought against them, The Herald reports.

The allegations emerged after an employment tribunal involving a manager for the company, Fraser Macintyre, who was given the job of investigating the allegations.

As a result, he suffered from stress and anxiety among other issues and eventually resigned. He has now succeeded in his constructive dismissal and unpaid wages case and has won more than £13,000.

Judgment in the case states: “In March 2020 the claimant was asked… to undertake an investigation in relation to an incident which had happened at Hamilton Sheriff court.

“A prisoner had allegedly been assaulted by five of the respondent’s security staff while in custody. The complaint had been made by another member of staff who claimed they witnessed the assault.”

Mr Macintyre was told that the CCTV footage of the incident had been lost.

The judgment states: “His conclusion was that there was insufficient evidence to justify taking further action.”

After this, however, he was told there would be an investigation into his investigation. Geoamey confirmed that four employees were dismissed.

A spokesman added: “Whilst we are naturally disappointed that the tribunal did not find in our favour, we accept the verdict and will look to identify any constructive learning points for our business.”
